MyUniverse Terms of Service

Company: My Universe, LLC ("MyUniverse," "we," "us," or "our")

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of MyUniverse websites, applications, profiles, contact cards, shared pages, media features, websites, artificial-intelligence features, and related products and services (collectively, the "Service").

By accessing or using the Service, creating a registered account, accessing a MyUniverse shared link, submitting information through a MyUniverse feature, or otherwise using functionality that requires acceptance of these Terms, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, do not use the Service.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. If changes materially affect your rights or obligations, we may provide additional notice where required by law.

2. Eligibility

You must be at least 13 years old to use MyUniverse.

If you are under the age at which you can independently enter into binding agreements in your jurisdiction, you may use the Service only with the permission of a parent or legal guardian where required by applicable law.

The Service is not directed to children under 13.

3. Registered Accounts

Certain MyUniverse features require a registered account.

If you create an account, you agree to:

4. Temporary Anonymous Access

Certain MyUniverse features may be used without creating a registered MyUniverse account.

For example, a recipient of a MyUniverse shared contact card or private sharing link may be granted temporary authenticated access through an anonymous authentication credential.

MyUniverse currently uses Firebase Anonymous Authentication for certain temporary-access features.

Anonymous authentication may create a temporary technical authentication account and unique identifier so MyUniverse can securely provide access to information protected by authentication and database security rules.

A temporary anonymous authentication account is not the same as a registered MyUniverse account.

A person using MyUniverse anonymously may later be offered the opportunity to create a registered MyUniverse account, profile, contact card, website, or other content.

Registration is optional and requires a separate affirmative signup action.

5. MyUniverse Contact Cards and Sharing

MyUniverse allows users to create and share profiles, contact cards, contact information, websites, media, documents, QR codes, vCards, and other selected content.

5.1 Temporary Shared Links

Some sharing features use temporary private links.

Unless otherwise displayed when a link is created, a temporary MyUniverse shared-card link may remain available for up to 7 days after creation.

A link may become unavailable earlier if:

Expiration of a shared link does not necessarily delete information previously downloaded or independently saved by a recipient.

5.2 vCards and Contact Downloads

MyUniverse may allow users and recipients to download contact information in vCard or similar formats.

Once information has been downloaded to a device, contact manager, address book, or third-party service, that copy may no longer be under MyUniverse's control.

Recipients are responsible for their use, storage, security, and disclosure of downloaded information.

5.3 Share Back

A recipient of a shared MyUniverse contact card may be offered the opportunity to voluntarily share their own contact information back with the MyUniverse user who sent the card.

Share Back information may include information such as:

Before submission, the recipient will be informed that the submitted information will be provided to the sender.

A recipient does not need to create a registered MyUniverse account solely to submit Share Back information.

Temporary Share Back records are generally retained by MyUniverse for up to 3 days from submission, after which they are scheduled for deletion from the temporary Share Back system.

Limited records may be retained longer where reasonably necessary for security, fraud prevention, abuse prevention, troubleshooting, dispute resolution, compliance with law, enforcement of these Terms, or protection of MyUniverse and others.

The sender may separately save contact information they receive into their own contacts, device, files, address book, CRM, or another service. Copies saved independently by the sender are no longer temporary MyUniverse Share Back records and may be outside MyUniverse's control.

6. Optional Signup Following a Shared Card

A recipient may be offered an opportunity to:

MyUniverse does not treat temporary anonymous access alone as registration for a permanent MyUniverse account.

7. Your Content

You retain ownership of content you upload, submit, create, or store through MyUniverse ("User Content").

You grant MyUniverse a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, resize, encode, convert, display, transmit, analyze, and otherwise use your User Content as reasonably necessary to operate and provide the Service and features you request.

You represent that you have the rights and permissions necessary to submit the content and authorize its processing as described in these Terms.

7.1 Free-Form Fields, Prompts, Notes, and Uploads

MyUniverse provides features that allow users to enter free-form text and upload files and media, including prompts, notes, descriptions, biographies, website instructions, documents, images, audio, video, and other content.

MyUniverse does not determine or control all information that a user may voluntarily include in these fields or files and may not know whether a submission contains personal, confidential, proprietary, sensitive, or third-party information.

You are responsible for deciding what information and content you submit and for ensuring that you have any rights, permissions, or consents necessary to upload, process, publish, share, or use that content through MyUniverse.

You should not submit information or content that you are legally prohibited from possessing, disclosing, transmitting, processing, or sharing.

8. Artificial Intelligence Features

MyUniverse may provide optional features that use artificial intelligence, machine learning, transcription, generative media, or related technologies ("AI Features").

AI Features may be provided using third-party commercial AI and media-generation services, including services provided by companies such as OpenAI, Anthropic, Replicate, and ElevenLabs, as well as other providers identified in our Privacy Policy or applicable feature notices.

8.1 Optional Use

AI Features are optional unless clearly stated otherwise.

You do not need to use optional AI Features in order to maintain a standard MyUniverse account or use non-AI portions of the Service.

8.2 Information Used by AI Features

When you affirmatively choose to use an AI Feature, you authorize MyUniverse to process and transmit information reasonably necessary to perform the requested AI operation.

MyUniverse may present an AI-processing notice before information is sent to a third-party AI provider.

After receiving that notice, selecting an action clearly identified as an AI action—such as:

constitutes your affirmative request for MyUniverse to perform that specific AI operation using the information identified for the feature.

Declining an optional AI Feature does not prevent you from using non-AI MyUniverse features.

8.5 AI Service Providers

MyUniverse intends to use commercial or API services intended for business application development rather than personal consumer AI subscriptions when processing production MyUniverse user information.

Third-party AI providers process information under their own commercial terms, privacy commitments, data-processing agreements, retention rules, security requirements, and MyUniverse's applicable configuration.

8.6 Model Training

MyUniverse does not intentionally authorize its AI service providers to use MyUniverse customer content to train their general-purpose AI models unless:

  1. MyUniverse separately discloses that practice;
  2. any consent required by applicable law is obtained; and
  3. the practice is otherwise permitted by law.

If MyUniverse materially changes this practice, we will update our disclosures and obtain additional consent where required.

8.7 AI Output

AI-generated content may:

MyUniverse does not guarantee the accuracy, originality, legality, availability, or suitability of AI-generated output.

AI output should not be treated as legal, medical, financial, engineering, tax, or other regulated professional advice.

8.8 Rights to AI Inputs

You may not knowingly submit content to an AI Feature unless you have the rights or authorization necessary to use that content for the requested purpose.

Because prompts, notes, uploads, documents, media, and other fields may contain information MyUniverse did not specifically request or anticipate, you are responsible for ensuring that any personal, confidential, proprietary, sensitive, or third-party information you submit to an AI Feature may lawfully be processed for the requested purpose.

9. MyUniverse Intellectual Property

The Service, including software, interfaces, designs, logos, branding, templates, graphics, functionality, and materials provided by MyUniverse, is owned by MyUniverse or its licensors and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable right to use the Service for its intended personal, professional, and business purposes.

10. Public, Shared, and Private Content

MyUniverse allows users to choose how certain profile information, contact information, media, websites, documents, and other content are made available.

Depending on the feature, content may be treated as:

10.1 User-Selected Public Information

When you affirmatively publish information or content to a public MyUniverse profile, public contact card, public website, public media gallery, or other public feature, you direct MyUniverse to make the selected information publicly accessible.

Publicly published information may include contact or profile information, media, documents, websites, or other content you choose to make public.

Public information may be:

Changing public content back to private or deleting it from MyUniverse cannot guarantee deletion of copies previously obtained or retained by others.

10.2 Shared or Restricted Content

Content you make available through a temporary share link, selected recipient, group, or other restricted feature is not intended to be public.

MyUniverse may use authentication, authorization checks, temporary sharing credentials, signed URLs, signed playback tokens, and similar access controls to limit access to shared or restricted content.

Recipients may still be able to download, save, screenshot, record, copy, or forward information they are authorized to access.

10.3 Private Content

Private content is intended for the account owner or other specifically authorized users.

MyUniverse may use technical measures such as authentication, Firebase security rules, temporary signed access URLs, signed video playback tokens, authorization checks, and other controls to protect private content.

No security measure can guarantee that unauthorized access will never occur.

11. Third-Party Services

MyUniverse may rely on third-party providers for services including:

Examples of third-party services used or that may be used by MyUniverse include:

12. Purchases and Subscriptions

If MyUniverse offers paid features or subscriptions, MyUniverse may use Stripe or another disclosed payment processor to process payments and billing information.

We may restrict content, links, features, or accounts where reasonably necessary to enforce these Terms or protect the Service and its users.

14. Security

You may not attempt to defeat or circumvent:

MyUniverse may use temporary signed URLs, authentication controls, access tokens, database security rules, signed playback credentials, and similar mechanisms to restrict access to private or protected User Content.

For private or restricted files stored through Google Cloud Storage, MyUniverse may use Google Cloud Storage V4 signed URLs or comparable temporary access mechanisms. These links may expire automatically and may be regenerated as necessary for authorized use.

For private or restricted video delivered through Mux, MyUniverse may use Mux signed playback or similar token-based access controls.

Content intentionally published by a user as public may be delivered through public-access mechanisms appropriate for publicly available content and may not require short-lived signed access credentials.

Expiration of a signed URL or playback token restricts access through that credential; it does not by itself delete the underlying file or media.

We may monitor for suspected abuse, fraud, security threats, and unauthorized activity.

15. Feedback

If you voluntarily provide suggestions, ideas, or feedback regarding MyUniverse, you grant MyUniverse permission to use that feedback without compensation or restriction.

If you believe material available through MyUniverse infringes your copyright, contact:

Your notice should contain the information required by applicable copyright law, including identification of the copyrighted work, identification of the material at issue, contact information, required statements, and signature.

17. Changes to the Service

MyUniverse may add, modify, replace, suspend, or discontinue features.

Beta, experimental, preview, and AI functionality may change as the Service develops.

We do not guarantee that any particular feature will remain available indefinitely.

18. Availability

We do not guarantee that the Service will always be uninterrupted, error-free, secure, complete, or available.

We may conduct maintenance and correct errors at any time.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

MYUNIVERSE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND OTHER WARRANTIES TO THE EXTENT PERMITTED BY LAW.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYUNIVERSE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYUNIVERSE'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO MYUNIVERSE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. $100.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless My Universe, LLC and its officers, directors, employees, agents, affiliates, licensors, and suppliers from claims, losses, liabilities, damages, costs, and expenses arising from:

24. Electronic Communications

You agree that MyUniverse may provide service-related communications electronically, including through the Service or by email.

Registered users are responsible for maintaining reasonably accurate account contact information.

Marketing communications, if any, are subject to applicable consent and opt-out requirements.

25. Export and Sanctions Compliance

You may not use MyUniverse where doing so would violate applicable U.S. or international export, sanctions, or trade laws.

26. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where applicable law requires otherwise.

27. Dispute Resolution and Arbitration

Except where prohibited by law, disputes arising from or relating to these Terms or the Service will be resolved through binding arbitration administered by JAMS under its applicable rules.

Claims eligible for small claims court may be brought there where permitted.

Claims seeking certain injunctive relief relating to intellectual-property misuse or unauthorized system access may be brought in a court of competent jurisdiction where applicable.

TO THE EXTENT PERMITTED BY LAW, YOU AND MYUNIVERSE WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing:

This arbitration section does not limit rights that cannot lawfully be waived.

28. Miscellaneous

Severability. If any provision is unenforceable, it will be limited or modified to the minimum extent necessary, and the remaining provisions remain effective.

Waiver. Failure to enforce a provision does not waive future enforcement.

Assignment. You may not assign these Terms without our permission. MyUniverse may assign them in connection with a merger, acquisition, financing, restructuring, sale of assets, or similar transaction.

Force Majeure. MyUniverse is not responsible for failures caused by circumstances outside our reasonable control.

Entire Agreement. These Terms, the Privacy Policy, and any additional terms presented for particular features constitute the agreement governing your use of the Service.
